PAIA Manual

Prepared in terms of Section 51 of the Promotion of Access to Information Act, No. 2 of 2000

1. Introduction

This manual is designed to facilitate requests for access to records held by Mobyte PTY LTD ("Mobyte"), a private body offering custom software engineering and digital solutions. PAIA is designed to foster a culture of transparency and accountability in South African society, giving natural or juristic persons the right to access information from public and private bodies.

3. The Section 10 Guide of the Information Regulator

The Information Regulator has compiled a Guide on how to use PAIA. The Guide is available in all official languages and can be obtained directly from the Information Regulator's website (inforegulator.org.za) or at their offices.

4. Records Available in accordance with other Legislation

Mobyte keeps records in accordance with the following South African legislation, where applicable:

  • Companies Act No. 71 of 2008
  • Income Tax Act No. 58 of 1962
  • Value Added Tax Act No. 89 of 1991
  • Basic Conditions of Employment Act No. 75 of 1997
  • Protection of Personal Information Act No. 4 of 2013

5. Categories of Records Held by Mobyte

We maintain records of the following categories, though access to certain records may be restricted under Chapter 4 of PAIA (protection of third-party privacy, commercial confidentiality, etc.):

  • Operational & Engineering Records: Software design specifications, deployment diagrams, network topology logs, and architecture roadmaps.
  • Client Records: Service Level Agreements (SLAs), client contact forms, project proposals, and correspondence.
  • Financial Records: Invoices, tax assessments, and bank statements.

6. How to Request Access to Records

To request access to a record, the requester must complete the prescribed Form 2 (available on the Information Regulator's website) and submit it alongside the prescribed request fee to our Information Officer using our secure Contact Form.

The request must provide sufficient detail to enable Mobyte to identify the requested record and identify the requester's authority or right to access the record.
